Terms of Service

These Terms of Service ("Terms") govern your use of the Cliarity mobile application and related services (the "Service"). By creating an account or using Cliarity, you agree to these Terms. If you do not agree, do not use the Service.

1. What Cliarity is

Cliarity is a consumer educational tool that explains the contents of lab and imaging reports you upload. Cliarity is not a healthcare provider. The Service does not provide medical advice, diagnosis, or treatment. The Service is not a substitute for professional clinical judgment. Always consult a qualified clinician about your health.

2. Eligibility

You must be at least 17 years old to use Cliarity. By using the Service you confirm you have the legal capacity to enter into this agreement. If you are using the Service on behalf of someone else, you represent that you have authority to do so.

3. Account

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us at [email protected] if you suspect unauthorized access. You may delete your account at any time from Settings.

4. Subscriptions and purchases

• Auto-renewal.Monthly and annual subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the period ends. Cancel at any time in iOS Settings → Subscriptions or the Google Play Store.
• Pay-per-report. A single report credit is consumed once you submit a report. Credits are not refundable once consumed.
• Free tier. One free report per device. Abuse prevention may revoke free access.
• Refunds. Refunds are handled by Apple or Google according to their refund policies. Cliarity cannot directly issue refunds for App Store or Play Store purchases.
• Price changes. We may change subscription prices. We will notify you in advance and require your consent before charging the new price for an existing subscription, as required by Apple and Google.

5. Acceptable use

You agree not to:

• Upload content that does not belong to you or that you do not have permission to share.
• Upload content that is unlawful, infringing, harassing, or harmful.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use automated means to access the Service or scrape responses.
• Resell, redistribute, or otherwise commercialize the Service or its outputs.
• Bypass usage limits, security measures, or rate limiting.
• Use the Service to make decisions of clinical, legal, or financial significance without independent professional review.

6. Your content

You retain ownership of the lab and imaging report content you submit. By submitting content, you grant Cliarity a limited license to process that content for the purpose of generating analysis and storing the analysis result in your account history. We do not use your content to train models or to generate insights for other users.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR FREE. CLIARITY ANALYSES MAY CONTAIN MISTAKES, OMISSIONS, OR MISINTERPRETATIONS. DO NOT RELY ON CLIARITY FOR MEDICAL DECISIONS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIARITY AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

9. Indemnification

You agree to defend, indemnify, and hold Cliarity harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access if you violate these Terms or if we are required to by law. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive.

11. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to personal jurisdiction there.

12. Changes

We may update these Terms from time to time. We will post material changes to this page and update the effective date. Continued use of the Service after a change constitutes acceptance.
